These Terms of Service (“Terms”) govern your access to and use of the Pikup mobile app, website, and related services (“Pikup,” “Service,” “we,” “us,” or “our”). Pikup is a marketplace that helps customers arrange pickup, delivery, moving help, and transportation of items, furniture, and cargo with independent drivers.
By creating an account, signing in, requesting a trip, driving on the platform, or otherwise using Pikup, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Pikup.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use Pikup. You must provide accurate information and keep your account information current.
Drivers must satisfy Pikup onboarding requirements, including identity verification, vehicle verification, payment onboarding, service area eligibility, and any other safety or operational requirements shown in the app.
2. What Pikup Provides
Pikup provides technology that connects customers who need items transported with independent drivers who may accept those requests. Pikup is not a moving company, carrier, freight broker, insurance company, or employer of drivers unless required by applicable law.
Drivers choose whether to accept requests and are responsible for safely performing accepted trips. Customers are responsible for providing accurate pickup, drop-off, item, access, timing, and contact information.
3. Accounts and Security
You are responsible for activity on your account. Keep your login credentials secure. Notify us promptly if you believe your account has been compromised.
You may not create accounts with false information, impersonate another person, share accounts, evade enforcement, or use Pikup for unlawful or unsafe activity.
4. Customer Responsibilities
Customers must:
- Provide accurate pickup and drop-off addresses.
- Provide accurate item descriptions, dimensions, weight estimates, photos, condition, value, receipt, and fragility information.
- Be available at the pickup and drop-off locations or ensure an authorized person is available.
- Ensure items are lawful, safe, accessible, and ready for pickup.
- Disclose stairs, elevators, parking restrictions, access codes, building rules, loading zones, and any conditions that may affect the trip.
- Review AI-generated item details and correct errors before confirming an order.
- Pay all applicable trip charges, fees, tips, cancellation charges, waiting charges, insurance charges, and other amounts shown in the app.
5. Driver Responsibilities
Drivers are independent providers and must:
- Maintain a valid driver profile, payment onboarding, identity verification, and vehicle information.
- Use a safe, legal, roadworthy, insured vehicle appropriate for accepted trips.
- Follow applicable traffic, parking, labor, safety, and transportation laws.
- Handle items with reasonable care.
- Follow pickup/drop-off instructions that are lawful and safe.
- Communicate professionally through the app.
- Complete trips accepted through the platform unless cancellation is permitted.
- Not request or accept off-platform payment for Pikup trips.
Drivers are responsible for their taxes, licenses, permits, insurance, equipment, helpers, and compliance obligations unless applicable law says otherwise.
6. Prohibited Items and Activities
You may not use Pikup to transport or request transport of:
- People or animals.
- Illegal goods, stolen goods, contraband, weapons, explosives, or hazardous materials.
- Controlled substances, drug paraphernalia, or regulated medical products unless expressly allowed by law and Pikup.
- Cash, negotiable instruments, securities, high-value collectibles, or irreplaceable items unless expressly accepted by Pikup in writing.
- Perishable goods requiring temperature control.
- Items that are unsafe, unsanitary, infested, leaking, unstable, or not reasonably movable.
- Any item prohibited by law, provider rules, insurance terms, or Pikup policy.
You may not harass, threaten, discriminate, commit fraud, damage property, bypass Pikup payments, interfere with the app, scrape data, reverse engineer the service, or misuse AI, maps, payments, messaging, or claims features.
7. AI Item Analysis and Estimates
Pikup may use AI services, including Google Gemini, to analyze item photos, estimate item details, estimate weight, recommend vehicles, and assist with pricing or trip preparation.
AI outputs are estimates and may be incomplete or incorrect. You must review and correct all item details before submitting an order. Pikup does not guarantee AI accuracy, vehicle fit, weight estimates, labor estimates, or insurance eligibility based only on AI output.
8. Pricing, Payments, and Payouts
Customer payments are processed through Stripe or another payment provider. By using Pikup, you authorize Pikup and its payment providers to authorize, capture, refund, or release payments according to the app flow and these Terms.
The final amount may include delivery charges, labor time, waiting time, distance, service fees, tips, insurance or protection charges, cancellation fees, adjustment charges, taxes, and other amounts shown in the app.
Drivers may receive payouts through Stripe Connect or another payout provider after eligible completed trips, less Pikup fees, refunds, chargebacks, adjustments, insurance/provider fees, or other permitted deductions. Payout timing depends on Stripe, banking rails, risk review, compliance checks, and Pikup policies.
Pikup may place holds, delay payouts, reverse payouts, or require additional verification when needed for fraud prevention, disputes, chargebacks, compliance, safety, or suspected policy violations.
9. Cancellations, No-Shows, Waiting, and Adjustments
Cancellation rules, waiting charges, and trip adjustments may depend on trip status, driver assignment, arrival, route, item changes, access issues, and other operational factors shown in the app.
Customers may be charged if they cancel after a driver has accepted or started traveling, are not available, provide inaccurate information, add undisclosed items, fail to provide access, or otherwise prevent completion of a trip.
Drivers may be penalized or lose eligibility for payout if they cancel improperly, fail to arrive, fail to complete accepted work, damage items through misconduct, or violate Pikup policy.
Pikup may make reasonable pricing adjustments for material differences between the order details and the actual trip, including additional items, extra labor, waiting, route changes, access issues, or vehicle mismatch caused by inaccurate information.
10. Insurance, Protection, and Claims
Pikup may offer optional or automatic insurance/protection quotes for eligible items through Redkik or another provider. Coverage is not guaranteed until a provider confirms the quote or policy and the required charge is successfully processed.
Insurance/protection may be limited by item condition, item type, declared value, receipts, photos, exclusions, deductibles, coverage limits, claim deadlines, provider review, and other terms. Used items, prohibited items, missing receipts, inaccurate descriptions, late claims, insufficient evidence, or excluded events may not be covered.
Submitting a claim in Pikup does not guarantee reimbursement. You must provide accurate claim information, photos, documents, receipts, and any other evidence requested by Pikup or the provider. Claims may be denied by Pikup, Redkik, or the applicable provider according to their terms.
Pikup is not an insurance company and does not underwrite coverage.
11. Damage, Loss, Disputes, and Support
If an item is damaged, lost, delayed, or disputed, you must report it promptly through the app or support. Pikup may review trip records, photos, messages, GPS data, payment records, driver/customer history, and provider information.
Pikup may facilitate communication, claims, refunds, credits, charge adjustments, or other resolution steps at its discretion or as required by law. Pikup is not responsible for losses caused by inaccurate order information, prohibited items, poor packing, pre-existing damage, unsafe access, customer/driver misconduct, third-party property rules, weather, traffic, or events outside Pikup’s reasonable control.
12. Location, Maps, and Navigation
Pikup uses location, maps, geocoding, routing, and navigation services to show service availability, match drivers, estimate route information, and support active trips. Routes, ETAs, distance, and map data are estimates and may be inaccurate or unavailable.
Drivers must use independent judgment and comply with traffic laws and safety requirements at all times.
13. Communications
You agree to receive service-related communications, including account, trip, payment, verification, safety, claim, support, and policy messages by app, email, SMS, phone, or push notification where available. You may control optional communications in app or device settings where supported.
14. Account Deletion
You may delete your account in the app. Account deletion removes or anonymizes account data unless Pikup must retain limited records for legal, tax, accounting, payment, insurance, fraud prevention, safety, or dispute resolution purposes.
If you used Sign in with Apple, Pikup will attempt to revoke the Apple authorization token where technically available. If automatic revocation cannot be completed, you may also revoke Pikup access from your Apple ID settings.
15. Suspension and Termination
Pikup may suspend, restrict, or terminate access to the service if we believe you violated these Terms, created risk, provided inaccurate information, failed verification, abused payments or claims, engaged in unsafe conduct, or if required by law or a provider.
You may stop using Pikup at any time.
16. Intellectual Property
Pikup, including the app, website, software, design, branding, content, and related technology, is owned by Pikup or its licensors. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Pikup except as allowed by law.
You retain rights to content you upload, but you grant Pikup a worldwide, non-exclusive, royalty-free license to host, process, display, transmit, and use that content as needed to operate, improve, secure, and support the service.
17. Third-Party Services
Pikup relies on third-party services such as Supabase, Stripe, Stripe Identity, Stripe Connect, Mapbox, Google Gemini, Google Cloud Vision, Google Maps services, Twilio, Redkik, Apple, Google, hosting providers, and other vendors. Your use of Pikup may also be subject to their terms and privacy policies.
Pikup is not responsible for third-party outages, delays, errors, policy decisions, verification results, payment decisions, insurance decisions, or provider terms.
18. Disclaimers
Pikup is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted service, driver availability, trip acceptance, AI accuracy, route accuracy, insurance approval, claim approval, payout timing, or that the service will meet every need.
To the maximum extent permitted by law, Pikup disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
19. Limitation of Liability
To the maximum extent permitted by law, Pikup will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, or business interruption.
To the maximum extent permitted by law, Pikup’s total liability for any claim relating to the service will not exceed the amount you paid to Pikup for the specific trip giving rise to the claim, or 100 USD if no trip payment applies.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
20. Indemnity
You agree to defend, indemnify, and hold harmless Pikup, its owners, operators, affiliates, vendors, and personnel from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, your content, your violation of these Terms, your violation of law, your misconduct, your inaccurate information, or your interaction with another user.
21. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law rules, unless mandatory law in your location requires otherwise.
Before filing a formal claim, you agree to contact info@pikup-app.com and try to resolve the dispute informally. If a dispute cannot be resolved informally, it will be handled in the state or federal courts located in Georgia, USA, unless applicable law requires another forum.
22. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, or other reasonable means. Your continued use of Pikup after changes become effective means you accept the updated Terms.
